Full Tilt can not patent Rush Poker?

The InstaDeal Poker Network will launch a game mode very similar to Rush Poker after legally struggling with Full Tilt Poker that could not patent the Rush Poker. Strangely PokerStars had already expressed a few months ago their intention to launch its own version of Rush Poker but so far it did not expressed this result.
